The Illinois Legislature made history today becoming the second state legislative body to pass a bill repealing cannabis prohibition, joining the great state of Vermont. But, they went one step further by also legalizing regulated cannabis commerce.

Once Democratic Governor J.B. Pritzker’s signs the bill, Illinois will officially be the 11th State to legalize cannabis in the US. This move gives more strength to the common sense decision to end Federal prohibition on cannabis.

On January 1, 2020 adults in “Illinois will legally be able to purchase up to 30 grams of cannabis flower, five grams of concentrates and 500 milligrams of cannabis-infused products. These things won’t actually be available on New Year’s Day though.” As seen in many other states, the regulatory hoops usually take a bit of time to get through.

Historic FDA Hearing Today! Cannabis Companies Lobby the FDA to Fully Legalize CBD.

Today, the FDA held its first hearing on whether companies can add CBD, a non-intoxicating cannabis compound, to food, beverages and dietary supplements.

“In 2018, the Farm Bill removed hemp and derivatives such as CBD from the federal list of controlled substances so long as THC percentages don’t exceed .03%, but the law gave the FDA the authority to regulate all cannabis compounds, including CBD. The FDA has had a relative hands-off approach so long as companies haven’t made exaggerated claims about curing Alzheimer’s or cancer, but it would be good for the cannabis industry and consumers to have clarity, so long as the FDA doesn’t unnecessarily stifle the market.”[3]

The FDA is not likely to make any decision on the first hearing. The regulators will more than likely collect data on safety and effectiveness of CBD and see how it can regulate the industry. The process will go a step forward if majority opinion goes in favor of CBD. One thing we’ve learned from walking through the licensing process and dealing with the local government is that it is really important for people to show up at public events, workshops, and hearings to help mold the industry in the way you want to see it develop.

Novato Cannabis Status:

At their May 14, 2019 meeting, the City Council held a Cannabis Community Workshop to receive public comment and discuss the option to tax cannabis businesses or activities. Council provided feedback to staff, and staff will continue this process at a future Council meeting. Learn more.

Fairfax Cannabis Status

Marin County doesn’t currently have any brick-and-mortar recreational cannabis storefronts. Fairfax Town Council heard public comment as it moves toward a local ordinance and permitting process recently, and it’s possible they could become the first city in Marin with a retail storefront for the recreational cannabis market.

In July 2019, the City of San Rafael will be opening a second round of licensing for the following cannabis licenses:

  • Cannabis Testing Labs: 4 licenses available. Process opening July 2019

  • Infused Product Manufacturing MIPs: 10 licenses allowed, 3 licenses available. Process opening July 2019

  • Non-storefront  Delivery: 5 licenses allowed.  All licenses allocated.

  • Distribution: 4 licenses allowed, 2 licenses available. Process opening July 2019.

Winter Greens Delivery (@wintergreensdeliver) is a cannabis delivery service dedicated to educating and guiding its customers about the validated benefits of cannabis for health. Dan, Colleen, and Ashley sit down for a conversation in Sacramento after a recent Flow kana industry party where they got to meet some of the farmers, a glass blower, and other industry members. They couldn't find anywhere quiet to talk so they have this conversation from the inside of a car. 

The discussion is centered around Ashley as she talks about Winter Greens and the experience she's had since they first opened on Jan. 28th, 2019. They are North Lake Tahoe and Truckee's 1st and ONLY licensed cannabis delivery service. When asked about some of the challenges she mentions the weather conditions as the drivers attempt to deliver weed in the middle of a snowstorm. I can imagine it being extra tricky trying to deliver cannabis in the middle of a blizzard - props to the winter greens delivery drivers. Tips are always appreciated.

Defining the Black Market in California’s Cannabis Industry

Did you realize you were contributing to its growth when you purchase products from unlicensed cannabis businesses - including the one’s operating under “Prop 215.”

In California, cannabis legalization began back in 1996 with the passing of Proposition 215. “Prop 215 made exempt patients and defined caregivers who possess or cultivate marijuana for medical treatment recommended by a physician from criminal laws which otherwise prohibit possession or cultivation of marijuana.” It allowed owners of medical recommendations to purchase cannabis from retailers operating under the Prop 215 classification.

Fast forward to today, where Prop 64 is the new regulatory standard and businesses operating under Prop 215 are considered “black market” operations. “Black market cannabis is primarily untested and leaves an open door for some of the industry’s worst practices.” Proposition 64 passed in 2016 and took effect in 2018. Prop 64 legalized Adult-Use sales and consumption but also includes regulations for the Medical industry, while doing away with Prop 215. Because many black-market cannabis businesses are hosted on platforms such as WeedMaps it’s common for consumers to assume they’re purchasing safe, quality products from any business claiming to offer cannabis products. It simply isn’t the case.

Given the new regulations it’s tempting to purchase cannabis from the Black market. The new standards for licensed business and new taxes have increased the prices for licensed businesses, making products more expensive for consumers. It's tough to witness small farmers, small manufacturers, and even delivery/retail businesses not able to survive under the new standards. However, for the health of the plant, people and the industry, purchasing from licensed retailers ensures a future for this clean source of medicine.

In California, if you purchase a product from a dispensary or delivery service the item will have gone through multiple safety checks to ensure what you’re buying is pure cannabis with zero contaminants. Licensed cannabis businesses have a certain standard to uphold and will be fully transparent and able to provide reports including detailed information regarding cannabinoid potencies and terpene analysis, plus pesticide, fungicide and PGR residue results on request.”

Below is a list of negative effects caused when purchasing cannabis from unlicensed businesses:

●      It’s bad for your health. Untested cannabis commonly fosters mold, pesticides, and other harmful chemicals. “One common pesticide among illegal growers contains the chemical carbofuran, which has been banned in the U.S., Canada and the EU for years. It takes only a sixteenth of a teaspoon of carbofuran to kill a human being [1].”

●      It’s harmful to the environment. “Pesticide residue can linger in soil, in extraction equipment and in five generations of plants. A research scientist who has been studying the environmental effects of illegal marijuana grows in Northern California has found chemical runoff as much as four years after a cultivation site was abandoned – killing protected species, seeping into other agricultural areas and making its way up the food chain.”

●      It hinders the growth of the industry. When licensed businesses lose money to the illegal market society takes the hit. Operating in the legal market means individuals may receive state approved jobs, giving them access to benefits and other opportunities otherwise unavailable to them. As the black market thrives, it strangles the ability of license holders to hire more employees.

You think you’re getting a better deal by purchasing “cheaper” cannabis from unlicensed businesses, but it actually does more harm than good – to you and society. At times it doesn’t feel like the actions we take in our personal lives make a difference, but this isn’t one of those times. The cannabis industry is the perfect example of an industry where the people hold the power. It shows in the way states continue legalizing cannabis in the face of Federal prohibition. People are showing up to the polls and making change happen. You as the voter, individually and collectively, are forcing politicians to listen.

As the legal cannabis industry grows it needs more individuals to step up and begin buying into it.
